Our Council currently has two district plans - the Operative in part District Plan (2024) and the Operative District Plan (2010)
RMA Requirements
The Resource Management Act 1991 requires all District Councils to have a District Plan for their district. District Plans describe the district's significant resource management issues and set out the objectives, polices and rules to address these issues.
Thames-Coromandel District Plan - Operative in part
Our Council issued its decisions on the Proposed District Plan on 29 April 2016.
The period for lodging an appeal to the Environment Court on the Council's decisions closed on 13 June 2016.
Those parts of the Thames-Coromandel District Plan - Operative in part (2024) that are not subject to appeal are operative. Corresponding objectives, policies and provisions in the Operative District Plan (2010) cease to have an effect.
Operative District Plan (2010)
The Operative District Plan (2010) continues to have legal effect to the extent that any corresponding objectives, policies and provisions in the Operative in part 2024 District Plan have been appealed. As appeals are resolved these provisions will cease to have effect and the Thames-Coromandel District Plan Operative in part (2024) will be relied on.
How do I know which parts of the plan are being appealed?
The provisions of the Plan (maps) which are subject to an Environment Court appeal have the appeal number written on the map i.e. Appeal 00.
Which Plan should I use?
The Thames-Coromandel District Plan - Operative in Part (2024) should be referred to in the first instance for information about a proposed land use, subdivision or development.
If the provisions in the Operative in part District Plan (2024) are subject to an appeal that has not been settled i.e., are in red font; then the equivalent provisions in the Operative District Plan (2010) should also be considered.
