Building Warrant of Fitness & Compliance Schedules

What is a compliance schedule?

A compliance schedule is issued by Council and lists the building’s specified systems, and the inspection, maintenance and reporting procedures needed to keep them in good order.

Applying to Amend an Existing Compliance Schedule

An amendment to a Compliance Schedule may be required for several reasons during the life of the building including

  • a change in ownership or building details
  • a change to the Building Act or regulations
  • to include or delete a specified system 
  • to ensure that the specified systems stated in the compliance schedule are performing to the performance standards for that system

Applying for a building consent to add / alter / remove a specified system

When applying for a building consent to add / alter / remove a specified system (which includes a residential cable car, new commercial building or an addition / alteration to an existing commercial building, you'll be required to submit the appropriate forms for all specified systems present in the building.  These can be found on the Build Waikato Website.  These details need to be supplied to Council specifically on the Compliance Schedule detail forms.  

Building Owners Responsiblities

These include ensuring:

  • a compliance schedule is obtained where necessary
  • the compliance schedule is available for inspection
  •  they meet the inspection requirements by engaging an independent qualified person(s) (IQP) approved by the Council to inspect certain specified systems
  • that any necessary maintenance of the specified systems occurs
  • an annual building warrant of fitness (BWoF) is provided to council by the expiry date.  
  • All records pertaining to specified system inspection and testing for two years are kept and available for inspection on the premises
What is a building warrant of fitness?

A Building Warrant of Fitness (BWoF) is an annual statement signed by the building owner (or owners’ agent) confirming that all specified systems present in a commercial building have been maintained and checked in accordance with the Compliance Schedule over the 12 months prior and that all systems are operating effectively.

This BWoF must be displayed in the building in a prominent place.

BWoF Inspections / Audits

The Building Act 2004 requires Council to administer, monitor and enforce the building warrant of fitness system. 

Periodically Council will complete an audit of the specified systems in your building and the records kept by your IQP.

A fee at the current rate may be applicable for the initial audit and any follow up audit as required.  Refer to Building consent Fees and Charges
