Part 4 - Liquor Bans 2004

Part 4 of the Bylaw prohibits the consumption and possession of liquor in all public places at certain times

Our Liquor Ban bylaw provides for temporary and permanent bans of alcohol consumption and possession in public places in our district, including on roads, reserves, playgrounds and beaches. The rules differ by settlement area and around certain events like Beach Hop and Taste of Matarangi, so it is important to check the bylaw schedule for where and when liquor ban periods apply.

This bylaw empowers the New Zealand police to enact the rules, so if you are drinking alcohol in a public place then the police are able to request you to stop and take further action if required. The bylaw doesn't apply though when you have purchased alcohol and are carrying it in a public place, unopened, to a place which is licensed for liquor consumption or to a private place for its consumption. 

The bylaw was made on 21 September 2004, and reviewed on 9 September 2009. It will be reviewed again within ten years of the last review date. A number of minor amendments have been made to the bylaw and its schedules over that time, which do not impact on the review timeframes.


401 Scope

This Part of the Consolidated Bylaw 2004 gives effect to the provisions of the Thames Coromandel District Council Liquor Bans Policy, as they relate to the Thames Coromandel District.

The part applies over the whole of the Thames-Coromandel District.


402 Definitions

In this bylaw:

LIQUOR has the meaning given to it in the Sale and Supply of Alcohol Act 2012.

OFFENCE means an offence under section 239 of the Local Government Act 2002 that is a breach of a bylaw prohibiting

(a) the consumption or possession or both of liquor in, or the bringing of liquor into, a public place; or

(b) in conjunction with a prohibition relating to liquor, the presence or use of a vehicle in a public place.

PUBLIC PLACE -

(a) means a place defined in the schedules-

(i) that is under the control of the Thames-Coromandel District Council; and

(ii) that is open to, or being used by, the public, whether or not there is a charge for admission; and

(b) includes-

(i) a road, whether or not the road is under the control of the Thames-Coromandel District Council; and

(ii) any part of a public place.

(c) but excludes any public place which is set aside for al fresco dining and is included in a license issued under the Sale and Supply of Alcohol Act 2012.

During the currency of this bylaw the following activities are prohibited in the public places and at the times specified as set out in Schedule A:

(b) The consumption of liquor in such public places

(c) The bringing of liquor into such public places

(d) The possession of liquor in such public places

During the currency of this bylaw and in conjunction with the above prohibitions the presence or use of a vehicle is prohibited in the public places and at the times specified as set out in Schedule B.

This bylaw authorises any member of the New Zealand Police to act under sections 169 and 170 of the Act including the power under section 170(2) to immediately and without further notice search a container or vehicle.

This bylaw does not prohibit, in the case of liquor in an unopened bottle or other unopened container -

(e) the transport of that liquor from premises that adjoin a public place during any period when, under the Sale and Supply of Alcohol Act 2012, it is lawful to sell liquor on those premises for consumption off the premises, provided the liquor is promptly removed from the public place:

(f) the transport of that liquor from outside a public place for delivery to premises that adjoin the public place, provided the premises are licensed for the sale of liquor under the Sale and Supply of Alcohol Act 2012:

(g) the transport of that liquor from outside a public place to premises that adjoin a public place -

(i) by, or for delivery to, a resident of those premises or by his or her bona fide visitors; or

(ii) from those premises to a place outside the public place by a resident of those premises, provided the liquor is promptly removed from the public place.

The places dates and times set out in the schedules may be amended from time to time by resolution of the Thames-Coromandel District Council.


408 Penalty

Any person who commits a breach of the bylaw is on conviction liable to a fine not exceeding $20,000.00.


409 Effective date

This part will come into effect on 6 October 2004.
